Terms of Service

These Terms of Service ("Terms") govern your use of the Peekabooker platform ("Platform", "Service") operated by Peekabooker Ltd ("we", "us", "our"), a company registered in England and Wales. By creating an account or using the Platform, you agree to these Terms.

1. What Peekabooker Does

Peekabooker provides booking links with automated dynamic pricing for small service businesses such as barbers, salons, escape rooms, and similar. Business owners ("Merchants") create services and share booking links with their customers ("Customers"). Our pricing engine adjusts prices based on demand, time of day, lead time, and other factors to help Merchants optimise their revenue.

2. Accounts

• You must provide accurate information when creating an account.
• You are responsible for keeping your login credentials secure.
• One person or legal entity per account. Sharing accounts is not permitted.
• You must be at least 18 years old to create a Merchant account.

3. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or to promote illegal activities.
• Attempt to interfere with, compromise, or disrupt the Platform's infrastructure.
• Scrape, crawl, or use automated tools to extract data from the Platform without our written consent.
• Misrepresent your identity or business information.
• Use the Platform to send spam or unsolicited communications.
• Resell or redistribute access to the Platform without authorisation.

4. Payment Processing and Fees

Payments are processed through Stripe on behalf of Merchants. When a Customer completes a booking:

• Peekabooker charges a 5% platform fee on each transaction.
• Stripe's standard processing fees also apply and are deducted from the payout.
• The remaining amount is transferred to the Merchant's connected Stripe account.

We are not a payment processor. Stripe handles all card processing, chargebacks, and fund transfers. By using the Platform, Merchants also agree to Stripe's Terms of Service.

5. Dynamic Pricing

Peekabooker's pricing engine automatically adjusts booking prices based on factors including demand, peak hours, booking velocity, and lead time. Merchants set their own base (off-peak) prices and peak hour parameters. By using the Platform, Merchants acknowledge and consent to automated price adjustments within the parameters they configure.

6. Bookings and Cancellations

• Bookings made through the Platform represent an agreement between the Customer and the Merchant.
• Peekabooker facilitates bookings but is not a party to the service contract between Merchant and Customer.
• Cancellation and refund policies are set by each Merchant. We encourage Merchants to communicate these clearly.

7. Intellectual Property

The Platform, its design, code, pricing algorithms, and branding are owned by Peekabooker Ltd. You may not copy, modify, or create derivative works from any part of the Platform. Content you upload (such as business descriptions and service details) remains yours, but you grant us a licence to display it on the Platform.

8. Limitation of Liability

To the fullest extent permitted by law:

• The Platform is provided "as is" without warranties of any kind, whether express or implied.
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
• Our total liability for any claim related to the Service shall not exceed the fees you have paid to us in the 12 months preceding the claim.
• We are not responsible for disputes between Merchants and Customers, including service quality, no-shows, or refund disagreements.

Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

9. Availability

We aim to keep the Platform available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify users of planned downtime.

10. Termination

• You may close your account at any time by contacting us.
• We may suspend or terminate your account if you breach these Terms, with or without notice depending on the severity.
• Upon termination, your right to use the Platform ceases immediately. We will process any outstanding payouts owed to Merchants, subject to Stripe's policies.
• Sections on liability, intellectual property, and governing law survive termination.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
